DOT-C2 Approved NTC 5807 Conspicuity Markings Tape is highly Retroreflective Microprismatic marking tapes designed for application to the rugged outdoor use on the sides and rear of trucks, trailers for enhanced visibility and detection. The reflective tape consists of prismatic lenses that are formed in a transparent, synthetic resin, sealed and backed with a pressure sensitive adhesive and clear poly liner. About NTC 5807 Reflective Tape

Considering

That in accordance with Article 1 of Law 769 of 2002, as amended by Law 1383 of 2010, it is the responsibility of the Ministry of Transport as the supreme authority on transit to define, guide, monitor, and inspect the implementation of national policy on transit

That article 27 of Law 769 of 2002, all vehicles circulating in the national territory must comply with the general requirements and mechanical and technical conditions conducive to safety, hygiene, and comfort within the corresponding regulations on weight and dimensions.

That according to literal e) of Article 2 of Law 105 of 1993 and clause 5 of article 1 of Law 769 of 2002 modified by Law 1383 of 2010, the security of the users constitutes a guiding principle of the National Code of Transit and a priority of the System and the Transport Sector.

That Colombian Technical Standard 5807, aims to define minimum requirements for retroreflective material for the demarcation of cargo vehicles.

That through Resolution 538 of 2013, the Ministry of Commerce, Industry, and Tourism issued the technical regulation applicable to retro-reflective tapes for use in motor vehicles and their trailers that are manufactured, imported, or commercialized in Colombia.

That through Resolution 1282 of 2012, the National Plan for Road Safety was adopted, and through Resolution 2273 of 2014, the Vehicle pillar of the said plan was adjusted, establishing, among other things, that retro-reflectivity in cargo vehicles and school transportation should be regulated, in order to make this type of vehicles more visible and thus reduce traffic accidents where this cause is involved, especially when environmental conditions are of low visibility.

That the Ministry of Commerce recommended through the ex-post Regulatory Impact Analysis of June 2017, that the Ministry of Transportation, through the National Agency for Road Safety – ANSV, carry out the pertinent actions in order to evaluate the identified problem, as well as its effects, since, in its role as natural regulator, it is the one that can establish the pertinent solution.

That in title 1.3 “Effectiveness of the Technical Regulations” of the ex-post Regulatory Impact Analysis (AIN) conducted by the Regulatory Directorate of the Ministry of Commerce, Industry and Tourism, it was determined that it has been an ineffective measure, since the problem is associated to “the conditions of low or low light where the visibility of a motor vehicle decreases, making it difficult to identify on the road”. In this sense, the regulation of technical and performance characteristics of retro-reflective tapes, without requiring the mandatory use of retro-reflective tapes, is insufficient as a measure to reduce road accidents.

That according to the information provided by the Observatory of the National Agency for Road Safety, between the years 2015, 2016, and 2017, 1466 fatalities, 8689 injuries, and 36 deaths were recorded. 175 crashes with damage, in accidents against buses, trucks, industrial machinery, agricultural machinery, truck tractors, dump trucks, in conditions of poor lighting, hail, rain, fog or in the night or early morning conditions, circumstances in which the lack of light signaling systems influenced as a factor of high risk and road safety.

That the Ministry of Transport for the month of December 2015, prepared a technical document whose objective was to have a technical basis according to the regulations of the UNECE, for the approval of the installation of light signaling devices of motor vehicles and their trailers and the approval of type vehicles with categories M2, M3, N1, N2, N3 and their trailers (category O) with regard to the installation of light signaling devices.

That vehicle retro-reflective strips are intended to warn road users of the presence of other vehicles. Also, according to the Federal Motor Carrier Safety Administration – FMCSA, retro-reflective strips help reduce accidents involving the rear or side of truck trailers and tractors at night or under other conditions of reduced visibility.

Even though all motor vehicles and nonmotor vehicles have “optical assemblies”, that is, service lights, boundary lights, turn signals, brake and reverse lights, their effectiveness decreases as a result of damage caused by their operation, lack of driver activation, illuminated area or drop in the battery charging system that exposes even the same vehicle and its driver to being impacted by others during the night. Therefore, the use of retro-reflective tapes guarantees visibility even under these conditions and allows for the mitigation of the risk of impact.

That visibility with tapes is also useful on the side edges of vehicles when they enter the roads at night so that they are visible even without the exposure of service light beams or rear position lights.

That according to the above, it is necessary to regulate the installation and mandatory use of retro-reflective tapes in motor and non-motor vehicles, in order to protect the life of the country’s road users.

That by means of memorandum 20181010073763 of 2018, the Deputy Minister of Transportation of the Ministry of Transportation sent to the Legal Counsel’s Office, the present administrative act for the pertinent procedure.

That the content of this Resolution was published on the website of the Ministry of Transport, in compliance with the provisions of paragraph 8, Article 8 of Law 1437 of 2011, Article 2.1.2.1.14 of Decree 1081 of 2015 amended and added by Decree 270 of 2017 and Resolution 994 of 2017 of the Ministry of Transport, in order to receive opinions, comments, and alternative proposals.

That the Legal Office of the Ministry of Transport will keep the documents associated with the process of disclosure and citizen participation including schedules, minutes, comments, recordings, and reports that evidence the publicity of the project and the participation of citizens and interest groups, as well as the observations submitted to this administrative act and the responses given. All of this is in accordance with the entity’s document management and archive policies.

On the basis of the above.

Solve

Article 1. Object. To regulate the installation and obligatory use of retro-reflective tapes in motor vehicles, their trailers and semi-trailers, destined for the transport of passengers or cargo, that transit on public or private roads that are open to the public.

Article 2. Definitions. For the correct application and interpretation of this resolution, the following definitions shall be taken into account:

Bus: Motor vehicle destined to the transport of persons and their luggage, duly registered according to the rules and special characteristics in force, with a capacity of more than 30 passengers.

Bus: Motor vehicle destined to the transport of persons and their luggage with a capacity of 20 to 30 passengers and a distance between axles of less than 4 meters.

Truck: Motor vehicle that due to its size and destination is used to transport cargo, with the manufacturer’s gross vehicle weight exceeding 5 (five) tons.

Truck. A motor vehicle intended for the transportation of passengers and/or cargo with a capacity of not more than nine (9) passengers or up to 5 (five) tons of gross vehicle weight from the manufacturer.

Retroreflective tape. Material composed of a transparent, flat, and smooth outer film with retroreflective elements embedded under the film, so that they constitute an unexposed retroreflective optical microprismatic system.

Microbus: Vehicle designed to transport people with a capacity of 10 to 19 passengers.

Trailer: Non-motorized vehicle, pulled by a tractor unit to which it does not transmit weight. Equipped with its brake system and reflective lights.

Semi-Trailer: Non-motorized vehicle, to be pulled by a motor vehicle on which it rests and transmits part of its weight, equipped with a braking system and reflective lights.

Tractor Truck: A motor vehicle intended to tow one or more semi-trailers or trailers, equipped with a coupling suitable for that purpose.
Dump Truck: Self-propelled vehicle intended mainly for the transportation of construction materials, equipped with a box that can be emptied by a transversal or vertical rotation on one or more axles.

Vehicles obliged to use retro-reflective belts. The motor vehicles, their trailers, and semi-trailers, type: Bus, Minibus, Bus, Truck, Tractor Truck, Tipper, Trailer, and Semi-Trailer that transit on public or private roads that are open to the public, must use retro-reflective strips.

The vehicles referred to in this article, registered in other countries, that travel on public or private roads open to the Colombian public must use any type of retro-reflective tape or position lights in the side and rear sectors.

Paragraph 2. Agricultural, industrial, and self-propelled construction machinery that travels on public roads, private roads that are open to the public, or on private roads must use retro-reflective tape.

Article 4. Conditions of installation and use. The conditions of installation and use of retro-reflective tapes will be as follows:

1. Side marking: Red-white-red tape not less than five (5) cm high in strips on the surface of the side edge of the vehicle, parallel to the floor. Marking of front and rear top corners.

Tape height: At least 250 mm and not more than 1,500 mm from the ground. On the lowest available panel.

Side Belt Extension: At least eighty percent (80%) of the total vehicle length must be covered. The untaped space shall not exceed 3 meters.
At the front and rear sidewalls, the belt shall be located no more than 600 mm from the corresponding end.

The top corners shall be taped at not less than 250 mm per line and not more than 400 mm from the top edge of the vehicle.

2. Rear Marking: Red tape not less than five (5) cm high, across the width and height of the rear end of the body, at the edges of the body.

Height of lower belt: At least 250 mm and not more than 1,500 mm from the ground.

Side edge belts: closest to the edge of the body.

Top edge tape: No more than 400 mm from the top edge of the vehicle.

Extension of the tape: Must cover at least eighty percent (80%) of the rear body edges.

3. White Ribbons: Not mandatory. However, if any vehicle makes use of white retroreflective tape, it shall be placed only on the front bumper of the vehicle within 60 cm of the outer edge of the bumper.

Platform type bodies shall be marked with strips of at least ten (10) centimeters of the colors indicated in this article for rear marking, or two lines of five (5) cm, without requiring the marking of upper corners on the side edge, or side edges of the rear end.

Paragraph 2. The vehicles whose design prevents the installation of the tapes based on the dimensions of this article shall follow the illustrations of the graphic annex of this resolution so that the installation is similar to that of the graphic.

Article 5. Specifications of the elements of light signals. The strips to be installed must comply with the conditions indicated in Resolution 538 of February 25, 2013, of the Ministry of Commerce, Industry, and Tourism, or the standard that modifies, adds or replaces it.

Article 6º. Prohibition. No vehicle that travels on public or private roads that are open to the public, may:

• a. Carry white retro-reflective or light bands or other elements at the rear or at the side, with the exception of the reverse lights, or red at the front,
• b. Carry in the covers of the lights: meshes, dyes, erosions, grinding, or alterations of the surface that diminish in any way its luminosity.
• c. The retro-reflective tape must not be covered by any element or in conditions that prevent its visibility.

Article 7. Control and surveillance. The transit authorities shall verify that the vehicles referred to in this resolution have the retro-reflective strips installed in accordance with the provisions of this administrative act and circulate using them. The verification may be advanced by using reflectometers or reflectometer to measure the retro-reflectivity of the tapes or elements incorporated into the vehicle.

Paragraph. Failure to comply with the provisions of this Resolution shall give rise to the sanctions established in Law 769 of 2002 or the regulation that modifies, adds or substitutes it

Article 8. Implementation. The motor vehicles, their trailers, and semi-trailers referred to in Article 3 of this resolution shall have a term of six (6) months as of the day following the publication of this resolution to install and use the retro-reflective tapes referred to in this administrative act.

Article 9. Validity. This Resolution shall be effective as of its publication in the Official Gazette.
